These Terms and Conditions ("Terms") govern access to and use of the website https://berget.dev and the purchase of web design services offered by Hotjoint Limited SL (NIF N0022032G), with registered address at Av. Arias Maldonado, 11, 5D, Marbella, 29602 ("Berget.dev", "we"). By using the site or purchasing a package, you accept these Terms.
1. Services
Berget.dev offers web design and development packages (Bronze, Silver, Gold, Premium) on a yearly or monthly basis. The scope, deliverables and price of each package are described on the website at the time of purchase.
2. Orders and formation of contract
The contract is formed when we confirm your order by email after successful payment. You must be at least 18 years old and provide accurate billing information.
3. Prices and payment
- Prices are shown in euros (EUR) and, where applicable, include Spanish VAT.
- Payment is processed securely by Stripe. Bank transfer may be offered as an alternative.
- Recurring subscriptions renew automatically until cancelled.
4. Delivery of services
Project timelines are agreed in writing after the initial briefing. Delivery depends on timely provision of content, feedback and approvals by the client.
5. Client obligations
- Provide accurate information, content and approvals within reasonable timeframes.
- Own or have the right to use all materials (text, images, logos) supplied to us.
- Comply with applicable laws when operating the website we deliver.
6. Intellectual property
Upon full payment, you receive a non-exclusive license to use the delivered website for your business. Berget.dev retains ownership of underlying frameworks, templates, and know-how, and may showcase the work in its portfolio unless otherwise agreed.
7. Right of withdrawal (consumers)
Consumers established in the EU have a 14-day right of withdrawal under Directive 2011/83/EU. This right does not apply once the service has been fully performed with your prior express consent, or for digital content supplied on a non-tangible medium once execution has begun with your consent (Art. 103 TRLGDCU).
8. Liability
To the maximum extent permitted by law, our liability for any claim relating to the services is limited to the amount paid by the client in the twelve months preceding the event giving rise to the claim. We are not liable for indirect or consequential losses.
9. Termination
Either party may terminate the contract for material breach not remedied within 15 days of written notice. Fees for services already performed remain payable.
10. Governing law and jurisdiction
These Terms are governed by Spanish law. Disputes shall be submitted to the Courts of Marbella, Spain, without prejudice to any mandatory consumer protection rules that grant consumers access to the courts of their place of residence.
11. Online dispute resolution
Consumers may also access the European Commission's ODR platform at ec.europa.eu/consumers/odr.
